Request: Area Variance(s) – Side Yard and Increase in Legal Non-Conformity: Submitted area variance request for proposed installation of (2) HVAC condenser units in the 10 ft. side yard setback on the northside of the property and church building. Therefore, requested area variance involves the impact to the setback of 4 ft. with a requested relief sought of 6 ft. therefore altering the property from the required 10 feet to a little more than 4 ft. from the neighboring property line. Additional area variance for an increase in non-conformity by proposing HVAC unit location within the side yard setback and with the Church building already within the setback. Request: Area Variance(s) (4) – Side Yard and (1) Increase in Legal Non-Conformity: Proposed renovation and addition to an existing single-family dwelling and proposed detached accessory dwelling unit which all proposed work will require area variances. Proposed area variances include: (1) for the north side of the residence involving the renovation and addition impacting the 10 ft. side yard setback with an impact of 3.8 feet and relief sought of 6.2 feet; (2) side yard setback on the south side of the residence to include proposed new HVAC with an impact of 3 feet and relief sought of 7 feet; (3 and 4) back of property and both north and south sides related to both side yards for the proposed 2-story accessory dwelling unit or ADU impacting the setbacks by 8.3 feet and relief sought of 1.7 feet. Proposed addition to residence totals 92 sq. feet. Additional area variance to address increase in the non-conformity of a legal non-conforming lot. Located in the Historic Overlay District and Residential District. Also, being located in the Historic District will require the project to return to the Planning Board for final approval.

Request: Area Variance(s) (3) – Side Yard (2) and (1) Increase or Continue the Non-Conformity of a Legal Non-Conforming 2-family: Proposed project to include demolition of existing fire damaged 2-family dwelling and detached garage. Proposed new 2-family dwelling to be rebuilt using existing foundation with new additions and new HVAC. Needed area variances include: (1) on the north side in the 10 ft. side yard setback of new 2-family dwelling to impact the setback by 5 feet and relief sought of 5 feet. (2) additional variance for proposed new HVAC units and system in the same side yard setback on north side of residence impacting by 5.6 feet and sought relief of 4.4 feet. (3) additional variance to continue the non-conformity by keeping the new 2-family dwelling within the setback. As a continued 2-family dwelling the Residential District the application will require a public hearing and final project approval from the Planning Board after the ZBA process. Located in the Residential District.

Request: Site Plan and Positive/Negative Recommendation to Zoning Board of Appeals (ZBA): Proposed application for site plan for the installation without prior approval of new HVAC system within the side yard setback and Historic Overlay District. The HVAC system installed 6 feet within 10 ft. side yard setback requiring sought relief of 4 feet. The installed system will be 4 feet from the closest property line of the neighbor to the north. Since the property is in the Historic District the applicant will need to return to the Planning Board for final approval following the ZBA process. Located in the Historic Overlay District and Residential District.
